Welcome to Juicy Cuticles! The terms “we,” “us,” and “our” refer to Juicy Cuticles. Juicy Cuticles operates this store and website, including all related information, content, features, tools, products, and services in order to provide you, the customer, with a curated shopping experience (the “Services”). Juicy Cuticles is powered by Shopify, which enables us to provide the Services to you.

The following terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or our Privacy Policy, you should not use or access our Services.

SECTION 1 – ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your province or territory of residence, or that you are the age of majority and have given consent for any of your minor dependants to use the Services on devices you own, purchase, or manage.

To use the Services, including accessing or browsing our online store or purchasing any products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all information you provide is correct, current, and complete and that you have all rights necessary to provide this information.

You are solely responsible for maintaining the security of your account credentials and for all activity associated with your account. You may not transfer, sell, assign, or license your account to another person.

SECTION 2 – OUR PRODUCTS

We make every reasonable effort to accurately represent our products and services. However, colours, packaging, and product appearance may vary slightly from what appears on your screen due to device displays, settings, product batches, or other factors.

We do not guarantee that the appearance of a product will be identical to photographs or digital representations shown on our website.

Product descriptions, scents, packaging, pricing, and availability are subject to change without notice. We reserve the right to discontinue products or limit quantities available to any person, geographic region, or jurisdiction.

SECTION 3 – ORDERS

When you place an order, you are making an offer to purchase. Juicy Cuticles reserves the right to accept, decline, limit, or cancel an order where reasonably necessary, including in cases of suspected fraud, pricing or inventory errors, misuse of promotions or wholesale pricing, or other circumstances affecting our ability to fulfill the order.

Your order is not accepted until payment has been successfully processed and the order has been confirmed.

Please review your order carefully before submitting it. Once an order has been accepted or entered processing, we may be unable to accommodate changes or cancellations.

If we need to change or cancel an order, we will attempt to contact you using the email address, billing information, or phone number provided with your order.

All purchases are subject to our Refund Policy.

Juicy Cuticles offers products for both personal use and authorized commercial resale. Purchases made for commercial resale must comply with our applicable wholesale terms, minimum quantities, pricing, and other requirements.

Wholesale pricing and benefits are intended for eligible professional or commercial purchases and may not be misused or obtained through attempts to circumvent applicable minimums or other requirements.

SECTION 4 – PRICES AND BILLING

All prices displayed on our website are in Canadian dollars (CAD) unless otherwise stated.

Prices, discounts, wholesale pricing, and promotional offers are subject to change without notice. The price charged will be the price in effect when your order is placed, subject to correction of obvious errors.

Unless otherwise stated, displayed prices do not include applicable taxes or shipping charges.

Wholesale prices, minimum quantities, suggested retail prices, discounts, and professional offers may be updated from time to time.

You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases made through our store.

You represent and warrant that any payment information you provide is accurate, that you are authorized to use the applicable payment method, and that charges incurred will be honoured by your payment provider.

SECTION 5 – SHIPPING AND DELIVERY

Juicy Cuticles currently ships within Canada only.

Order processing times and estimated delivery times are provided as estimates and are not guaranteed. Delivery times may vary depending on destination, carrier operations, weather, remote locations, holidays, and circumstances outside our reasonable control.

Shipping rates and available shipping options may vary depending on order size, destination, and applicable promotions or wholesale benefits.

Where tracking is available, tracking information will be provided after your order has shipped.

Customers are responsible for providing a complete and accurate shipping address at checkout. Juicy Cuticles is not responsible for delays or failed deliveries resulting from incorrect or incomplete shipping information provided by the customer.

Additional shipping charges may apply if an order is returned to us because of an incorrect address, refused delivery, or unsuccessful delivery attempt.

SECTION 6 – INTELLECTUAL PROPERTY

The Services and their contents, including but not limited to the Juicy Cuticles name, branding, logos, product names, text, photographs, graphics, designs, videos, and other original content, are owned by Juicy Cuticles or their respective licensors and are protected by applicable intellectual property laws.

You may access and use the Services for lawful personal or authorized commercial purposes associated with purchasing or retailing our products.

You may not reproduce, distribute, modify, republish, sell, exploit, or otherwise use our intellectual property without prior written permission, except where permitted by applicable law.

Nothing in these Terms grants you ownership of or a licence to Juicy Cuticles intellectual property except as expressly provided.

Shopify’s name, logos, product and service names, designs, and slogans are trademarks of Shopify. Other names, logos, product names, and trademarks appearing through the Services remain the property of their respective owners.

SECTION 7 – OPTIONAL TOOLS

We may provide access to tools or services offered by third parties that we do not monitor or control.

You acknowledge that access to these tools may be provided “as is” and “as available” without warranties, representations, or conditions of any kind.

Your use of optional third-party tools is at your own risk and discretion, and you should review the terms and policies applicable to those services.

We may introduce additional features, tools, or resources in the future. Such features will form part of the Services and will be subject to these Terms.

The Services may contain links to websites, services, or materials operated by third parties.

We are not responsible for evaluating or guaranteeing the content, accuracy, security, products, or services offered by third-party websites.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Juicy Cuticles is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Juicy Cuticles.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Juicy Cuticles, including any injury, damage, or loss resulting from purchased products and services.

You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Juicy Cuticles.

SECTION 10 – PRIVACY POLICY

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because our store is powered by Shopify, Shopify also collects and processes certain personal information in connection with your access to and use of the Services.

Information submitted through the Services may be transmitted to Shopify and other service providers, including providers located outside Canada, where necessary to operate our store and provide the Services.

SECTION 11 – FEEDBACK

If you voluntarily submit reviews, photographs, comments, suggestions, ideas, or other content (“Feedback”) to Juicy Cuticles, you grant us permission to use, reproduce, publish, display, and share that Feedback for purposes reasonably related to operating, improving, and promoting Juicy Cuticles and our products, subject to applicable law.

You represent that you have the necessary rights to submit the Feedback and that it does not infringe the rights of another person.

We reserve the right to remove Feedback that we reasonably determine is unlawful, abusive, misleading, infringing, or otherwise inappropriate.

SECTION 12 – ERRORS, INACCURACIES AND OMISSIONS

Occasionally, information available through the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times, inventory, or availability.

We reserve the right to correct errors or inaccuracies and to update information or cancel affected orders where necessary.

If an order is cancelled after payment because of an error on our part, the applicable payment will be refunded.

SECTION 13 – PROHIBITED USES

You may use the Services only for lawful purposes.

You may not use the Services to violate applicable laws or regulations; infringe intellectual property or privacy rights; transmit malicious software; engage in fraud or deceptive conduct; collect personal information without authorization; interfere with the security or operation of the Services; impersonate another person or entity; or engage in conduct that could reasonably harm Juicy Cuticles, Shopify, our customers, or other users.

You may not use automated systems, scraping tools, bots, or similar technology to access or extract information from the Services in violation of these Terms or applicable law.

We reserve the right to restrict or terminate access to the Services where we reasonably believe these Terms have been violated.

SECTION 14 – AGENTS

This section applies if you use or enable software or services that take autonomous or semi-autonomous actions on your behalf (“Agents”) to access or interact with the Services.

Agents must identify themselves appropriately and must not conceal their automated nature, circumvent CAPTCHAs or other access controls, misrepresent themselves as human users, or attempt to bypass measures designed to restrict automated access.

We may limit or prevent access by Agents where reasonably necessary to protect the Services, our customers, or our business.

SECTION 15 – TERMINATION

We may suspend or terminate access to the Services where reasonably necessary, including where these Terms have been violated.

You remain responsible for amounts properly owing up to the effective date of termination.

Any provisions that by their nature should survive termination will continue to apply.

SECTION 16 – DISCLAIMER OF WARRANTIES

To the extent permitted by applicable law, information available through the Services is provided for general informational purposes.

Except for warranties or consumer rights that cannot legally be excluded, the Services and products offered through the Services are provided without additional representations, warranties, or conditions beyond those expressly stated by Juicy Cuticles.

Nothing in these Terms is intended to exclude, restrict, or override rights or remedies that cannot be excluded under applicable consumer protection law.

SECTION 17 – LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Juicy Cuticles, its service providers, contractors, affiliates, and Shopify and its affiliates will not be liable for indirect, incidental, special, punitive, or consequential damages arising from your use of the Services or products purchased through the Services.

Nothing in these Terms limits liability that cannot legally be limited or excluded under applicable law.

SECTION 18 – INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless Juicy Cuticles, Shopify, and their respective affiliates, service providers, contractors, officers, directors, employees, and agents from third-party claims, losses, liabilities, or reasonable legal expenses arising from your material breach of these Terms, violation of applicable law, or infringement of another party’s rights.

SECTION 19 – SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by applicable law or severed where necessary.

The remaining provisions will continue in full force and effect.

SECTION 20 – WAIVER; ENTIRE AGREEMENT

Our failure to exercise or enforce a right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms, together with policies incorporated by reference, constitute the agreement governing your use of the Services and supersede prior versions concerning the same subject matter.

SECTION 21 – ASSIGNMENT

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.

We may transfer or assign our rights and obligations where permitted by applicable law.

SECTION 22 – GOVERNING LAW

These Terms of Service and any separate agreements through which Juicy Cuticles provides Services will be governed by and construed in accordance with the laws of the Province of Nova Scotia and the applicable federal laws of Canada.

Any disputes will be subject to the jurisdiction of the courts of Nova Scotia, except where applicable law provides otherwise.

Headings are included for convenience only and do not limit or otherwise affect the interpretation of these Terms.

SECTION 24 – CHANGES TO TERMS OF SERVICE

You can review the most current version of these Terms of Service on this page at any time.

We reserve the right to update or replace these Terms by posting changes to our website. Where required by applicable law, we will provide notice of material changes.

Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms, to the extent permitted by applicable law.

SECTION 25 – WHOLESALE TERMS

Wholesale pricing is available on orders of 25 or more Cuticle Oil Pens. Scents may be mixed and matched to meet the minimum order quantity.

Wholesale Cuticle Oil Pens are $9 each, with a suggested retail price of $16 each. Wholesale pricing is automatically applied when the minimum quantity is reached.

Qualifying wholesale orders receive free shipping within Canada.

Wholesale purchases are intended for commercial resale by nail professionals, salons, studios, and other beauty businesses. Wholesale orders are final sale except in the case of products that arrive damaged, defective, or incorrectly fulfilled.

Juicy Cuticles reserves the right to update wholesale pricing, minimum order quantities, suggested retail pricing, shipping offers, discounts, and other wholesale terms at any time.

That also ties in nicely with Section 3 of our revised Terms, where we already state that products can be purchased for authorized commercial resale — unlike Shopify's original template, which specifically prohibited commercial resale.
